General Terms and Conditions (GTC)

§1. Scope of Application

​

The following General Terms and Conditions (GTC) apply to all orders placed via our online shop, GSG Hair.

These GTC are governed by Austrian law, in particular the Consumer Protection Act (KSchG) and the Distance and Off-Premises Contracts Act (FAGG).

A "consumer" is any natural person who enters into a legal transaction for purposes that cannot be predominantly attributed to their commercial or independent professional activity. An "entrepreneur" is a natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.

These GTC apply to all current and future business relationships between the customer and GSG Hair. Deviating or supplementary terms and conditions of the customer shall not become part of the contract unless GSG Hair expressly agrees to their validity in writing.

§2. Contracting Parties and Conclusion of Contract

By listing products in the online shop, we make a binding offer to conclude a contract for these items. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order. The contract is concluded when you accept the offer by clicking the order button ("order with obligation to pay"). You will receive a confirmation via e-mail after submitting the order.

 

§3. Right of Withdrawal ​

 

As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day on which you, or a third party named by you (other than the carrier), take possession of the goods. To exercise your right of withdrawal, you may use the "Cancel Contract" withdrawal function on our website. Once you have submitted your withdrawal, you will receive an email confirming receipt. Alternatively, you may communicate your withdrawal to us by means of an unequivocal statement (e.g., via email) sent to the following address: ​ GSGHair Bahnhofstraße 2 5700 Zell am See Austria office@gsghair.com ​ You may use our return form for this purpose (optional but recommended); please enclose it with the returned goods. ​ Consequences of Withdrawal: ​ Upon receipt of the returned goods, we will refund the purchase price using the same payment method you used for the original transaction. You are responsible for the cost of the return shipment. Please return the goods to us within 14 days of your withdrawal. You are liable for any loss in value of the goods only if such loss is due to handling of the goods that was not necessary to establish their nature, characteristics, and functioning. ​

§4. Sealed Goods (Hair Extensions) ​

 

Our hair extensions are sealed hygiene products. Returns or exchanges are excluded if the hygiene seal has been removed after delivery. Color matching is possible through the transparent packaging without damaging the seal. Therefore, a return is only possible if the extensions are in their unopened original condition with the seal intact. ​

 

§5. Exchanges

 

Direct product exchanges are not possible.

If a customer wishes to have a different color, length, or product, they must place a new order and return the unwanted item in accordance with the right of withdrawal. Returns must be made in the original packaging; items must be unworn, unopened, and in a resalable condition. Goods that have been opened, worn, altered, or used in any way are excluded from exchange. If, upon return, the goods show visible signs of use, the packaging is missing, or the product is in a condition that makes resale impossible, a fee for diminished value may be charged, or the exchange may be refused. Customers should note that hair extensions are classified as hygiene products. Once the packaging has been opened or the product tested, an exchange is no longer possible. If an exchange is required due to an error on the part of GSG Hair (e.g., incorrect product or a defect), the exchange will be processed free of charge. The processing time for an exchange is generally 5–10 business days after receipt of the returned goods. The customer will be informed of the processing status via email.

§6. Prices and Shipping Costs ​

 

The prices stated include statutory VAT (sales tax) and other price components. Shipping costs may apply in addition to the stated prices; these are listed separately during the ordering process. For deliveries to countries outside the EU, customs duties and other fees may apply and must be borne by the customer. ​

 

§7. Delivery ​

 

Delivery is carried out by our shipping partners (e.g., Austrian Post, GLS, UPS, FedEx, DPD, etc.). Estimated delivery times are: Austria: 2–4 business days Europe: 3–7 business days International: 5–14 business days Express orders received Monday through Friday by 2:00 PM will be shipped on the same business day, provided express shipping was selected. Delivery time within Austria and Germany is generally 1–2 business days. Delays due to force majeure are possible. Special regulations apply to the delivery of hazardous goods; these are indicated on the respective product pages. Please note that delivery delays may occur in exceptional cases, such as during public holidays. We will inform you immediately if an item is unavailable. In the event of undeliverable packages (e.g., due to an incorrect address), we reserve the right to charge you for the costs incurred.

§8. Payment ​

 

The following payment methods are available: Credit card/debit card (e.g., Visa, Mastercard): Your card will be charged upon shipment of the goods. Apple Pay: By entering your account details, you grant us authorization to automatically collect the amount due. Google Pay: Goods will be shipped upon receipt of payment. You will receive our bank details with the order confirmation. Klarna (Invoice, Installment Payment, Sofort): We offer flexible payment options via Klarna. Further information can be found on the Klarna website. Please ensure that the payment details provided are correct to avoid processing delays. Any additional transaction costs or currency exchange fees for international payments must be borne by the customer. ​

 

§9. Retention of Title ​

 

The goods remain our property until full payment has been received. For business customers, the following also applies: We reserve ownership of the goods until all claims arising from the ongoing business relationship have been settled. Claims arising from the resale of goods subject to retention of title are assigned to us in advance in the amount of the invoice total. ​

 

§10. Warranty and Liability ​

 

Statutory liability rights for defects under the General Civil Code (ABGB) apply. We ask consumers to report obvious defects promptly upon delivery to ensure rapid processing. Business customers must report obvious defects without delay in accordance with the provisions of the Austrian Commercial Code (UGB). The statutory limitation period applies to hidden defects. Our liability is limited to cases of willful misconduct and gross negligence. In the event of slight negligence, we are liable only for the breach of essential contractual obligations (cardinal obligations), the fulfillment of which is a prerequisite for the proper execution of the contract. In such cases, liability is limited to foreseeable damage of the type typically occurring in such instances. Claims arising from personal injury or under the Product Liability Act remain unaffected by this.

§11. Dispute Resolution ​

 

In the event of disputes between consumers and GSG Hair, we strive to find an amicable solution together with our customers. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless there is a statutory obligation to do so. §13. Color Representations and Deviations

 

Please note that the representation of hair colors on our website may vary depending on screen settings, lighting conditions, and individual color profiles. Minor deviations between the displayed color and the delivered product do not constitute a defect and do not entitle the customer to make a claim or return the product. We are happy to provide advice should you have questions regarding a more precise color selection. ​

§15. Final Provisions ​

 

If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships shall be our place of business. Austrian law applies, excluding the UN Sales Convention (CISG). Should individual provisions of these General Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a provision that comes closest to the intended economic purpose. Statutory provisions apply supplementarily unless otherwise regulated.
